These Terms of Service ("Terms") are entered into by and between you (the "User") and Hopped Up History Education LLC, doing business as Hopped Up History ("we," "us," or "our"). You also agree not to: i. impose unreasonably large loads on our infrastructure; ii. disrupt the Services’ operations; iii. bypass access restrictions; iv. use automated tools to scrape, crawl, or harvest data; v. reverse-engineer or modify the Services without permission; vi. violate local, state, national, or international laws.
We reserve the right to access and disclose any data if necessary to: i. comply with legal obligations; ii. enforce these Terms; iii. protect against fraud or technical issues; iv. respond to support requests; v. protect the rights and safety of our users.
2) Third-Party Services
Our Services may contain links to third-party websites or tools. These are not under our control, and we are not responsible for their content or services. Accessing such sites is at your own risk.
3) Payments and Billing
A. Paid Services. Some Services require payment. Current pricing is available on our site.
B. Billing. Payments are processed by a third-party provider. We are not responsible for payment errors. By signing up, you authorize us to charge your chosen payment method.
C. Recurring Billing. Subscriptions may auto-renew unless canceled via your account settings. Charges continue unless you cancel in advance.
D. Payment Information. You must keep your billing information accurate and current.
E. Subscription Changes. Price changes or plan updates will be communicated, and you are responsible for monitoring your account.
F. Auto-Renewal. Subscription-based Services will automatically renew unless canceled. No prorated refunds are provided unless otherwise stated.
G. Free Trials. Trials must be canceled before expiration to avoid charges.
4) Membership Plans & Subscriptions
By enrolling in our membership plans (e.g., Homeschool Essentials, Self-Paced Scholar), you agree to the pricing and terms outlined on our Membership page. Subscriptions renew monthly or annually. Annual plans are non-refundable except in extreme circumstances.
5) Warranty Disclaimer
Our Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service.
6) Limitation of Liability
We are not liable for indirect or consequential damages, including lost profits or data. Our total liability shall not exceed the amount you paid for the Services in the last three months or $500, whichever is greater.
7) Indemnification
You agree to indemnify and hold harmless Hopped Up History Education LLC, our affiliates, and personnel from any claims or damages arising from your use of the Services or violation of these Terms.
8) Arbitration and Class Action Waiver
All disputes between you and Hopped Up History Education LLC will be resolved by binding arbitration under JAMS rules. You waive the right to participate in class actions. You may opt out within 30 days of first accepting these Terms by notifying us in writing.

These Terms are governed by the laws of the State of Alabama. Any disputes shall be resolved in state or federal courts located within Alabama.
10) Modifications
We may modify these Terms at any time. Updates will be posted on our website. Continued use of the Services after changes are posted constitutes acceptance.
11) Miscellaneous
These Terms constitute the full agreement between you and us. If any part is found unenforceable, the rest remains valid. These Terms are not transferable by you without our consent. Notices may be sent to the email you provided or posted on our website.
